Terms of Service

Welcome to Kelas Sekejap. These Terms of Service ("Terms") govern your access to and use of the Kelas Sekejap mobile application ("App") and related services provided by Kelas Sekejap Sdn Bhd ("Company", "we", "us", or "our").

By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

1. Eligibility

You must be at least 13 years old to use Kelas Sekejap. If you are under 18, you must have permission from a parent or legal guardian to use the App.

By using the App, you represent and warrant that you meet these eligibility requirements.

2. Account Registration

To access certain features of the App, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or violates these Terms.

3. Description of Service

Kelas Sekejap is an AI-powered language learning application that helps users improve their English speaking skills through:

• Conversational practice with AI personas
• Guided speaking exercises and lessons
• Progress tracking and personalized feedback
• Voice recognition and analysis

We continuously improve and update the App, and features may change without prior notice.

4. Subscriptions and Payments

Kelas Sekejap offers both free and premium subscription plans.

4.1 Apple App Store Purchases

All payments for subscriptions are processed through Apple's App Store. By subscribing, you agree to Apple's terms and conditions for in-app purchases. Payment will be charged to your Apple ID account upon confirmation of purchase.

4.2 Subscription Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

4.3 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial subscription periods.

4.4 Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to subsequent billing periods.

5. User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Upload or transmit viruses, malware, or harmful code
• Use the App to harass, abuse, or harm others
• Impersonate any person or entity
• Use automated systems or bots to access the App
• Reverse engineer, decompile, or attempt to extract the source code of the App

6. Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers and are protected by Malaysian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. User Content

When using the App, you may provide voice recordings and other content ("User Content"). You retain ownership of your User Content, but grant us a worldwide, royalty-free license to use, process, and analyze your User Content solely for the purpose of providing and improving our services.

You represent that you have all necessary rights to provide User Content and that it does not violate any third-party rights.

8. AI-Generated Content

The App uses artificial intelligence to generate responses and feedback. While we strive for accuracy, AI-generated content may occasionally contain errors or inaccuracies. The App is designed for educational purposes and should not be relied upon for professional language translation or interpretation.

9. Privacy

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee any specific learning outcomes from using the App.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

In no event shall our total liability exceed the amount paid by you, if any, for accessing the App during the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms in the App or by other means.

Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Malaysia.

16. Apple App Store Additional Terms

The following additional terms apply to your use of the App downloaded from the Apple App Store:

• These Terms are between you and Kelas Sekejap Sdn Bhd, not with Apple Inc. ("Apple")
• Apple has no obligation to provide maintenance, support, or warranty services for the App
• Apple is not responsible for any product liability claims or third-party intellectual property infringement claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
